Elle porte application de l&rsquo;article 115 de la loi 2017-1837 du 30 d\u00e9cembre 2017 (loi de finances pour 2018).<\/p>\n<p class=\"spip\">Le SNUipp avec la FSU reste oppos\u00e9 \u00e0 cette mesure injuste et inefficace, et demande le retrait de la journ\u00e9e de carence.<\/p>\n<dl class='spip_document_3352 spip_documents spip_documents_center' >\n<dt><img src='https:\/\/snuipp86.fr\/wp-content\/spip\/cache-vignettes\/L320xH157\/carence-51d71.jpg' width='320' height='157' alt='JPEG - 14.6 ko' style='height:157px;width:320px;' class='' \/><\/dt>\n<dt class='spip_doc_titre' style='width:320px;'><strong>carence<\/strong><\/dt>\n<\/dl>\n<h3 class=\"spip\" id=\"outil_sommaire_0\"><a title=\"Sommaire\" href=\"http:\/\/86.snuipp.fr\/spip.php?page=backend&#038;id_rubrique=#outil_sommaire\" class=\"sommaire_ancre\"> <\/a>Le principe g\u00e9n\u00e9ral<\/h3>\n<p class=\"spip\">Les agents publics (fonctionnaires titulaires et stagiaires, agents contractuels de droit public) ne per\u00e7oivent aucune r\u00e9mun\u00e9ration pour le d\u00e9lai de carence constitu\u00e9 du premier jour d&rsquo;un cong\u00e9 de maladie.<\/p>\n<h3 class=\"spip\" id=\"outil_sommaire_1\"><a title=\"Sommaire\" href=\"http:\/\/86.snuipp.fr\/spip.php?page=backend&#038;id_rubrique=#outil_sommaire\" class=\"sommaire_ancre\"> <\/a>La date d&rsquo;application<\/h3>\n<p class=\"spip\">Le jour de carence s&rsquo;applique \u00e0 compter du 1er janvier 2018.<\/p>\n<h3 class=\"spip\" id=\"outil_sommaire_2\"><a title=\"Sommaire\" href=\"http:\/\/86.snuipp.fr\/spip.php?page=backend&#038;id_rubrique=#outil_sommaire\" class=\"sommaire_ancre\"> <\/a>Le champ d&rsquo;application<\/h3>\n<p class=\"spip\">Ce d\u00e9lai de carence ne s&rsquo;applique pas aux cong\u00e9s pour :<br \/>\n<br \/> Acte de d\u00e9vouement dans un int\u00e9r\u00eat public ;<br \/>\n<br \/> Invalidit\u00e9 temporaire imputable au service ;<br \/>\n<br \/> Accident de service, accident de travail, maladie professionnelle<br \/>\n<br \/> CLM, CLD ;<br \/>\n<br \/> Grave maladie (pour les agents contractuels de droit public).<\/p>\n<p class=\"spip\">En cas d&rsquo;arr\u00eats de travail successifs li\u00e9s \u00e0 une m\u00eame affection de longue dur\u00e9e (ALD qui n\u00e9cessitent une interruption de travail ou des soins continus d&rsquo;une dur\u00e9e pr\u00e9visible \u00e9gale ou sup\u00e9rieure \u00e0 6 mois), le d\u00e9lai de carence ne s&rsquo;applique qu&rsquo;une seule fois au cours d&rsquo;une m\u00eame p\u00e9riode de 3 ans qui d\u00e9bute \u00e0 compter du 1er arr\u00eat. Si ce 1er arr\u00eat est ant\u00e9rieur au 1er janvier 2018, il y aura d\u00e9compte d&rsquo;une journ\u00e9e de carence au premier arr\u00eat de travail accord\u00e9 au titre de cette ALD intervenant \u00e0 compter du 1er janvier 2018.<\/p>\n<p class=\"spip\">Si un coll\u00e8gue en cong\u00e9 de maladie ordinaire (CMO) est plac\u00e9 r\u00e9troactivement, apr\u00e8s avis du comit\u00e9 m\u00e9dical, en CLM ou CLD, ou par d\u00e9cision de l&rsquo;administration ou avis de la commission de r\u00e9forme en accident de service ou maladie professionnelle, la retenue correspondant au jour de carence doit lui \u00eatre rembours\u00e9e.<\/p>\n<p class=\"spip\">Ce d\u00e9lai de carence ne s&rsquo;applique pas non plus aux cong\u00e9s de maternit\u00e9 (ni aux 2 cong\u00e9s suppl\u00e9mentaires li\u00e9s \u00e0 un \u00e9tat pathologique r\u00e9sultant de la grossesse ou des suites de couches), de paternit\u00e9 ou d&rsquo;adoption.<\/p>\n<p class=\"spip\">Il n&rsquo;y a pas d\u00e9compte d&rsquo;un nouveau jour de carence en cas de prolongation d&rsquo;un arr\u00eat de travail, ou quand la reprise du travail n&rsquo;a pas exc\u00e9d\u00e9 48 heures entre 2 cong\u00e9s maladie accord\u00e9s au titre de la m\u00eame cause (exemple : coll\u00e8gue qui a tent\u00e9 de reprendre et se trouve contraint de s&rsquo;interrompre de nouveau 1 ou 2 jours plus tard, ou coll\u00e8gue qui n&rsquo;a pas pu aller voir son m\u00e9decin le samedi, le dimanche ou un jour f\u00e9ri\u00e9 accol\u00e9 au week-end pour des raisons ind\u00e9pendantes de sa volont\u00e9). Dans ces conditions, le nouvel arr\u00eat est consid\u00e9r\u00e9 comme une prolongation.<\/p>\n<p class=\"spip\">Enfin, en cas de cumul journ\u00e9e de carence et retenue pour transmission tardive de l&rsquo;arr\u00eat maladie, celle-ci ne s&rsquo;applique qu&rsquo;\u00e0 partir du jour suivant le d\u00e9lai de carence.<\/p>\n<h3 class=\"spip\" id=\"outil_sommaire_3\"><a title=\"Sommaire\" href=\"http:\/\/86.snuipp.fr\/spip.php?page=backend&#038;id_rubrique=#outil_sommaire\" class=\"sommaire_ancre\"> <\/a>Le non versement de la r\u00e9mun\u00e9ration<\/h3>\n<p class=\"spip\">Le bulletin de paye devra indiquer la date et le montant retir\u00e9 au titre du jour de carence.<\/p>\n<p class=\"spip\">Le pr\u00e9l\u00e8vement repose sur la r\u00e8gle du 1\/30 \u00e8me et concerne le traitement principal, mais aussi les primes et indemnit\u00e9s qui sont li\u00e9es \u00e0 l&rsquo;exercice des fonctions (y compris l&rsquo;indemnit\u00e9 de r\u00e9sidence, la NBI, l&rsquo;ISAE, etc&#8230;). Par contre, le suppl\u00e9ment familial de traitement n&rsquo;est pas concern\u00e9.<\/p>\n<p class=\"spip\">En cas de temps partiel, l&rsquo;assiette de retenue est proratis\u00e9e.<\/p>\n<p class=\"spip\">La retenue doit en principe se faire sur la r\u00e9mun\u00e9ration du mois correspondant et intervenir le mois suivant.<\/p>\n<h3 class=\"spip\" id=\"outil_sommaire_4\"><a title=\"Sommaire\" href=\"http:\/\/86.snuipp.fr\/spip.php?page=backend&#038;id_rubrique=#outil_sommaire\" class=\"sommaire_ancre\"> <\/a>Les cotisations et la retraite<\/h3>\n<p class=\"spip\">Aucune cotisation (retraite, CSG, CRDS ; URSSAF et IRCANTEC pour les non titulaires) ne doit \u00eatre retenue pour le jour de carence.<\/p>\n<p class=\"spip\">Le jour de carence est compt\u00e9 comme du temps de service effectif et est pris en compte pour la retraite.
