Cette dur\u00e9e peut \u00eatre prolong\u00e9e ou de nouveau ouverte par un nouveau certificat m\u00e9dical dans les limites des 310 jours.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">Le d\u00e9compte de la p\u00e9riode de 36 mois s\u2019effectue \u00e0 compter de la date du 1er jour de pr\u00e9sence parentale.<\/span><\/span><\/p>\n<p><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">Un nouveau cong\u00e9 peut \u00eatre accord\u00e9 si et seulement si la p\u00e9riode de 36\u00a0mois est \u00e9coul\u00e9e**, sur pr\u00e9sentation d&rsquo;un nouveau certificat m\u00e9dical. <\/span><\/span><\/p>\n<p><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">Il concerne les situations suivantes\u00a0:<\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-size: small; font-family: Arial, serif;\">nouvelle pathologie affectant l&rsquo;enfant<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-size: small; font-family: Arial, serif;\">rechute ou r\u00e9cidive de la pathologie initialement trait\u00e9e<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-size: small; font-family: Arial, serif;\">la gravit\u00e9 de la pathologie de l&rsquo;enfant initialement trait\u00e9e n\u00e9cessite toujours une pr\u00e9sence soutenue et des soins contraignants.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\"><i>*jours effectivement travaill\u00e9s, \u00e0 l\u2019exception des jours f\u00e9ri\u00e9s habituellement non travaill\u00e9s<\/i><\/span><\/span><\/p>\n<p><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\"><i>** Il faut dissocier ouverture du droit \u00e0 cong\u00e9 de son utilisation effective. Dans ces conditions, il est important de d\u00e9poser sa demande au plus t\u00f4t.<\/i><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<h1 align=\"justify\"><span style=\"font-family: Tahoma, serif; color: #0000ff;\"><span style=\"font-size: small;\"><u><b>La demande :<\/b><\/u><\/span><\/span><\/h1>\n<p align=\"justify\"><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">Elle doit \u00eatre faite <strong>par \u00e9crit au moins 15 jours avant le d\u00e9but ou le renouvellement du cong\u00e9.<\/strong> Elle est accompagn\u00e9e d&rsquo;un certificat m\u00e9dical attestant la gravit\u00e9 de la maladie, de l&rsquo;accident ou du handicap et la n\u00e9cessit\u00e9 de la pr\u00e9sence soutenue du parent. Il pr\u00e9cise la dur\u00e9e pr\u00e9visible du traitement.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">En cas d&rsquo;urgence, le cong\u00e9 peut d\u00e9buter \u00e0 la date de la demande. Alors, le certificat m\u00e9dical sera transmis dans les 15 jours.<\/span><\/span><\/p>\n<h1 align=\"justify\"><span style=\"font-family: Tahoma, serif; color: #0000ff;\"><span style=\"font-size: small;\"><u><b>L&rsquo;organisation du cong\u00e9 :<\/b><\/u><\/span><\/span><\/h1>\n<p align=\"justify\"><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">La modalit\u00e9 du cong\u00e9 est \u00e0 la main de l\u2019agent\u00b7e. Il peut \u00eatre pris de mani\u00e8re continue, fractionn\u00e9e \u00e0 la journ\u00e9e ou en plusieurs p\u00e9riodes ou sous la forme \u201cd\u2019un temps partiel\u201d.<\/span><\/span><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\"> La modalit\u00e9 choisie ainsi que les dates pr\u00e9visionnelles de cong\u00e9 doivent figurer dans le courrier de demande.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">Les dates pr\u00e9visionnelles et l\u2019organisation sont modifiables \u201cde droit\u201d \u00e0 condition de le signaler par \u00e9crit au moins 48\u00a0heures \u00e0 l&rsquo;avance au chef de service. Ce d\u00e9lai ne s&rsquo;applique pas si la modification est due \u00e0 la d\u00e9gradation soudaine de l&rsquo;\u00e9tat de sant\u00e9 de l&rsquo;enfant ou \u00e0 une situation de crise n\u00e9cessitant la pr\u00e9sence imm\u00e9diate d\u2019un parent.<\/span><\/span><\/p>\n<h1 align=\"justify\"><span style=\"font-family: Tahoma, serif; color: #0000ff;\"><span style=\"font-size: small;\"><u><b>Cons\u00e9quences financi\u00e8res:<\/b><\/u><\/span><\/span><\/h1>\n<p align=\"justify\"><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">Ne sont retenus sur salaire <\/span><\/span><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\"><u><b>que les jours de classe<\/b><\/u><\/span><\/span><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\"> pour lesquels le coll\u00e8gue est effectivement absent. Ces jours-l\u00e0, il pourra percevoir l&rsquo;allocation journali\u00e8re de pr\u00e9sence parentale<\/span><\/span> <a href=\"https:\/\/www.caf.fr\/allocataires\/droits-et-prestations\/s-informer-sur-les-aides\/petite-enfance\/l-allocation-journaliere-de-presence-parentale-ajpp\"><span style=\"color: #0000ff;\"><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\"><u>AJPP<\/u><\/span><\/span><\/span><\/a> <span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">vers\u00e9e par la CAF. <\/span><\/span><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">A la date de cette circulaire, le montant de cette allocation, par jour, est de 43,87 euros pour un couple et 52,13 euros pour une personne seule.<\/span><\/span><\/p>\n<h1 align=\"justify\"><span style=\"font-family: Tahoma, serif; color: #0000ff;\"><span style=\"font-size: small;\"><u><b>Cons\u00e9quences sur la carri\u00e8re :<\/b><\/u><\/span><\/span><\/h1>\n<p><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">Ces cong\u00e9s <\/span><\/span><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">sont assimil\u00e9es \u00e0 du temps plein pour les droits<\/span><\/span><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\"> \u00e0 formation, \u00e0 promotion, \u00e0 avancement d&rsquo;\u00e9chelon et de grade. Se pose la question de cette p\u00e9riode pour le rechargement des droits \u00e0 CLM, temps partiel th\u00e9rapeutique\u2026.<\/span><\/span><\/p>\n<p><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">Le\/la fonctionnaire reste affect\u00e9-e dans son emploi.<\/span><\/span><\/p>\n<p><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">Pour le droit \u00e0 pension, ce cong\u00e9 est pris en compte, dans la limite de 3 ans par enfant n\u00e9 ou adopt\u00e9 depuis le 1er janvier 2004.<\/span><\/span><\/p>\n<p align=\"justify\"><span style=\"font-family: Tahoma, serif;\"><span style=\"font-size: small;\">Pour les contractuel-les, les p\u00e9riodes de cong\u00e9 de pr\u00e9sence parentale sont prises en compte pour<\/span><\/span><span style=\"color: #ff0000;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">\u00a0<\/span><\/span><\/span><a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2574\"><span style=\"color: #0000ff;\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\"><u>l&rsquo;assurance vieillesse du parent au foyer\u00a0(Avpf)<\/u><\/span><\/span><\/span><\/a><\/p>\n<h1><span style=\"font-family: Arial, serif; color: #0000ff;\"><span style=\"font-size: small;\"><u><b>Interruption du cong\u00e9 :<\/b><\/u><\/span><\/span><\/h1>\n<p align=\"justify\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">Si l\u2019agent-e souhaite \u00e9courter son cong\u00e9, il\/elle doit en informer son administration au moins 15 jours \u00e0 l&rsquo;avance. Il s\u2019interrompt, de fait, en cas de d\u00e9c\u00e8s de l\u2019enfant.<\/span><\/span><\/p>\n<h1><span style=\"font-family: Arial, serif; color: #0000ff;\"><span style=\"font-size: small;\"><u><b>Cas des stagiaires\u00a0:<\/b><\/u><\/span><\/span><\/h1>\n<p align=\"justify\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">La dur\u00e9e statutaire du stage du fonctionnaire stagiaire est incr\u00e9ment\u00e9e du nombre de jours ouvr\u00e9s \u00e9gal au nombre de jours et, le cas \u00e9ch\u00e9ant, de demi-journ\u00e9es, de cong\u00e9 de pr\u00e9sence parentale qu\u2019il\u00b7elle a utilis\u00e9s.<\/span><\/span><\/p>\n<h1><span style=\"font-family: Arial, serif; color: #0000ff;\"><span style=\"font-size: small;\"><u><b>Contr\u00f4le : <\/b><\/u><\/span><\/span><\/h1>\n<p align=\"justify\"><span style=\"font-family: Arial, serif;\"><span style=\"font-size: small;\">L\u2019administration peut proc\u00e9der \u00e0 une v\u00e9rification pour s\u2019assurer que l\u2019utilisation de ce cong\u00e9 est d\u00e9di\u00e9e effectivement aux soins \u00e0 son enfant.
