Et a contrario des AESH re\u00e7oivent des propositions de renouvellement de contrat alors m\u00eame qu&rsquo;ils et elles avaient signifi\u00e9 leur souhait de ne pas vouloir continuer au-del\u00e0 du terme de leur CDD actuel&#8230; Le SNUipp-FSU a demand\u00e9 \u00e0 \u00eatre re\u00e7u en audience par la DGRH ; l\u2019intersyndicale nationale a fait de m\u00eame aupr\u00e8s du nouveau ministre. <strong>AESH de la Vienne, n\u2019h\u00e9sitez pas \u00e0 nous faire remonter vos situations si vous \u00eates concern\u00e9-es \u00e0 aesh.fsu86@gmail.com<br \/>\n<\/strong><\/p>\n<p>Vous trouverez ci-dessous quelques \u00e9l\u00e9ments d\u2019information utiles sur comment est renouvel\u00e9 ou s\u2019ach\u00e8ve le contrat des agent\u00b7es contractuel\u00b7les de la Fonction publique.<\/p>\n<ul>\n<li>\n<h2 align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\"><b>Dur\u00e9e du contrat<\/b><\/span><\/span><\/h2>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Le CDD est \u00e0 dur\u00e9e d\u00e9termin\u00e9e, c\u2019est-\u00e0-dire qu\u2019au moment de l\u2019engagement, le contrat comporte une date de d\u00e9but et une date de fin. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Il n\u2019existe pas de droit au renouvellement de contrat et ce, m\u00eame si l\u2019agent\u00b7e est en cong\u00e9 maternit\u00e9 ou en cong\u00e9 de maladie \u00e0 la date de fin de contrat initialement <\/span><\/span><span style=\"font-family: Tahoma, serif;\">pr\u00e9vue.<\/span><\/p>\n<ul>\n<li>\n<h2 align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\"><b>Fin du contrat<\/b><\/span><\/span><\/h2>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">(<\/span><\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000045662677\"><span style=\"color: #0563c1;\"><span style=\"font-family: Tahoma, serif;\"><u>article 45, d\u00e9cret 86-83 du 17 janvier 1986<\/u><\/span><\/span><\/a><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">)<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Lorsque l\u2019agent\u00b7e est recrut\u00e9\u00b7e en CDD susceptible d\u2019\u00eatre renouvel\u00e9, l\u2019administration doit lui notifier son intention de renouveler ou non l\u2019engagement en respectant un d\u00e9lai de pr\u00e9venance, compte tenu de la dur\u00e9e de l\u2019ensemble des contrats\u00a0:<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">\u2714\ufe0e <\/span><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">deux mois avant le terme pour une dur\u00e9e sup\u00e9rieure ou \u00e9gale \u00e0 2 ans<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\">\u2714\ufe0e <\/span><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">trois mois avant le terme si le contrat est susceptible d\u2019\u00eatre renouvel\u00e9 en CDI<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Le juge consid\u00e8re que le non-respect du d\u00e9lai de pr\u00e9venance n\u2019est pas susceptible d\u2019entra\u00eener l\u2019ill\u00e9galit\u00e9 de la d\u00e9cision de non renouvellement mais il peut engager la responsabilit\u00e9 de l\u2019administration.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">La notification de renouvellement ou de non renouvellement doit \u00eatre obligatoirement pr\u00e9c\u00e9d\u00e9e d\u2019un entretien lorsque le contrat est susceptible d\u2019\u00eatre renouvel\u00e9 en CDI ou que la dur\u00e9e de l\u2019ensemble des contrats est sup\u00e9rieure ou \u00e9gale \u00e0 3 ans sans interruption.<\/span><\/span><\/p>\n<ul>\n<li>\n<h2 align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\"><b>Renouvellement de contrat<\/b><\/span><\/span><\/h2>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Lorsque l\u2019administration propose de renouveler le contrat, l\u2019agent\u00b7e dispose d\u2019un d\u00e9lai de 8 jours pour faire conna\u00eetre son acceptation ou non. En cas d\u2019absence de r\u00e9ponse dans ce d\u00e9lai, i<\/span><\/span><span style=\"font-family: Tahoma, serif;\">l ou elle <\/span><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">est pr\u00e9sum\u00e9\u00b7e renoncer \u00e0 l\u2019emploi.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Si l\u2019agent\u00b7e refuse le renouvellement de contrat, <\/span><\/span><span style=\"font-family: Tahoma, serif;\">il ou elle<\/span><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\"> n\u2019est pas consid\u00e9r\u00e9\u00b7e comme involontairement priv\u00e9\u00b7e d\u2019emploi. Les allocations ch\u00f4mage ne seront vers\u00e9es qu\u2019apr\u00e8s une p\u00e9riode de carence de 4 mois (121 jours). <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">En revanche, si le refus est motiv\u00e9 par un motif l\u00e9gitime li\u00e9 \u00e0 des consid\u00e9rations d\u2019ordre personnel ou une modification substantielle du contrat non justifi\u00e9e par l\u2019administration, les allocations ch\u00f4mage sont vers\u00e9es imm\u00e9diatement (<\/span><\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/ceta\/id\/CETATEXT000043328486?init=true&amp;page=1&amp;query=428312&amp;searchField=ALL&amp;tab_selection=all\"><span style=\"color: #0563c1;\"><span style=\"font-family: Tahoma, serif;\"><u>d\u00e9cision du Conseil d\u2019\u00c9tat du 2 avril 2021<\/u><\/span><\/span><\/a><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">).<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Nous conseillons aux AESH qui ne souhaitent pas poursuivre au-del\u00e0 de leur engagement d\u2019envoyer un courrier argument\u00e9 \u00e0 leur administration en faisant savoir qu\u2019i<\/span><\/span><span style=\"font-family: Tahoma, serif;\">ls ou elles<\/span><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\"> ne souhaitent pas qu\u2019une proposition de renouvellement de contrat leur soit adress\u00e9e. L\u2019engagement doit ainsi s\u2019arr\u00eater au terme du CDD.<\/span><\/span><\/p>\n<ul>\n<li>\n<h2 align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\"><b>Non renouvellement de contrat<\/b><\/span><\/span><\/h2>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Lorsque l\u2019administration d\u00e9cide de ne pas renouveler le contrat, la d\u00e9cision n\u2019a pas \u00e0 \u00eatre formellement motiv\u00e9e. Mais en cas de contentieux, le juge administratif contr\u00f4le les motifs r\u00e9els qui doivent \u00eatre <\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\"><i>\u00ab\u00a0tir\u00e9s de l\u2019int\u00e9r\u00eat du service ou pris en consid\u00e9ration de la personne\u00a0\u00bb<\/i><\/span><\/span><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">, qu\u2019ils aient ou non un caract\u00e8re disciplinaire\u00a0: suppression du besoin ou de l\u2019emploi, r\u00e9organisation du service, insuffisance professionnelle, faits tir\u00e9s du comportement de l\u2019agent\u00b7e, fautes reproch\u00e9es&#8230;<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Toute d\u00e9cision de non renouvellement de contrat en raison de l\u2019\u00e9tat de grossesse d\u2019une agente est ill\u00e9gale. <\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">Toute d\u00e9cision de non renouvellement de contrat fond\u00e9e sur la volont\u00e9 de priver l\u2019agent\u00b7e de la possibilit\u00e9 de b\u00e9n\u00e9ficier d\u2019un CDI serait entach\u00e9e de d\u00e9tournement de pouvoir.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000;\"><span style=\"font-family: Tahoma, serif;\">La d\u00e9cision de non renouvellement de contrat d\u2019un\u00b7e agent\u00b7e investi\u00b7e d\u2019un mandat syndical doit faire l\u2019objet d\u2019une consultation de la CCP.
