{"id":26380,"date":"2025-03-07T17:37:38","date_gmt":"2025-03-07T16:37:38","guid":{"rendered":"https:\/\/snuipp86.fr\/?p=26380"},"modified":"2025-04-22T14:58:09","modified_gmt":"2025-04-22T12:58:09","slug":"conge-de-maladie-ordinaire-modification-de-la-remuneration","status":"publish","type":"post","link":"https:\/\/snuipp86.fr\/index.php\/2025\/03\/07\/conge-de-maladie-ordinaire-modification-de-la-remuneration\/","title":{"rendered":"Cong\u00e9 de maladie ordinaire : modification de la r\u00e9mun\u00e9ration."},"content":{"rendered":"<table border=\"0\" summary=\"Recherche d'une circulaire\" cellspacing=\"5\" cellpadding=\"5\">\n<tbody>\n<tr>\n<td>\n<div>\n<p dir=\"ltr\"><strong>Malgr\u00e9 la forte mobilisation de la profession, la partie de la loi concernant le traitement en cong\u00e9 maladie ordinaire est pass\u00e9e : les trois premiers mois de cong\u00e9 maladie seront r\u00e9mun\u00e9r\u00e9s \u00e0 90% pour les arr\u00eats prononc\u00e9s \u00e0 compter du 1er mars 2025.\u00a0<\/strong><\/p>\n<\/div>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2><span style=\"color: #0000ff;\">Textes de r\u00e9f\u00e9rence<\/span><\/h2>\n<ul>\n<li><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">Loi de finance du 14 f\u00e9vrier 2025, <\/span><\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000051169572\"><span style=\"color: #1155cc;\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">Article 189<\/span><\/span><\/span><\/a><\/li>\n<li><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">Code G\u00e9n\u00e9ral de la Fonction Publique,<\/span><\/span><span style=\"color: #0000ff;\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\"><u> <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000051201136\">Article L822-3<\/a><\/u><\/span><\/span><\/span><\/li>\n<li><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGISCTA000006093762\/2025-03-04\/\"><span style=\"color: #1155cc;\"><span style=\"font-size: small;\"><u>D\u00e9cret n\u00b0 86-83 du 17 janvier 1986<\/u><\/span><\/span><\/a><span style=\"font-size: small;\"> relatif aux dispositions g\u00e9n\u00e9rales applicables aux agents contractuels de l&rsquo;Etat<\/span><\/li>\n<\/ul>\n<h2><span style=\"color: #0000ff;\">Modalit\u00e9s<\/span><\/h2>\n<p class=\"western\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\"><strong>A compter du 1er mars 2025,<\/strong> le\u00b7la fonctionnaire, ou l\u2019agent\u00b7e contractuel\u00b7le ayant plus de quatre mois de service, qui sera plac\u00e9\u00b7e en cong\u00e9 maladie ordinaire percevra : <\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">pendant trois mois, 90 % de son traitement indiciaire et des primes et indemnit\u00e9s qui suivent le traitement (ISAE, Prime d&rsquo;attractivit\u00e9\u2026) ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">pendant les neuf autres mois, la moiti\u00e9 de son traitement indiciaire et des primes et indemnit\u00e9s qui suivent le traitement (ISAE, Prime d&rsquo;attractivit\u00e9\u2026).<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">Il\u00b7elle conserve ses droits \u00e0 la totalit\u00e9 du suppl\u00e9ment familial de traitement et de l&rsquo;indemnit\u00e9 de r\u00e9sidence.<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\"><span style=\"color: #ff0000;\"><strong>Rappel :\u00a0<\/strong><\/span> certaines indemnit\u00e9s ne sont plus per\u00e7ues par le\u00b7la titulaire du poste d\u00e8s qu\u2019elles sont vers\u00e9es au\u00b7\u00e0 la rempla\u00e7ant\u00b7e (indemnit\u00e9 REP\/REP+, indemnit\u00e9 de direction\u2026)<\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\"><b>Ce qui ne change pas :<\/b><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">le d\u00e9lai de carence, il reste \u00e0 1 jour ;<\/span><\/span><\/p>\n<\/li>\n<li>\n<p align=\"JUSTIFY\"><span style=\"font-family: Calibri, serif;\"><span style=\"font-size: medium;\">les r\u00e9mun\u00e9rations vers\u00e9es pendant les CLM et CLD. La p\u00e9riode de cong\u00e9 de maladie ordinaire requalifi\u00e9e en CLM ou CLD sera r\u00e9mun\u00e9r\u00e9e \u00e0 100% avec effet r\u00e9troactif.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p><strong>Attention :<\/strong> le rectorat de Poitiers indique \u00ab\u00a0De mars \u00e0 juin 2025, la r\u00e9mun\u00e9ration des agents concern\u00e9s restera inchang\u00e9e. Toutefois<span style=\"color: #ff0000;\">, <strong>une r\u00e9gularisation sera effectu\u00e9e, \u00e0 compter de juillet 2025<\/strong>,<\/span> pour prendre en compte r\u00e9troactivement les nouvelles dispositions.\u00a0\u00bb<\/p>\n<h2><strong><span style=\"color: #0000ff;\">Avis de la FSU<\/span><\/strong><\/h2>\n<p>Injuste et injustifiable, la r\u00e9duction de 100% \u00e0 90% de la r\u00e9mun\u00e9ration maintenue au titre de l\u2019indemnisation des trois premiers mois en cong\u00e9 maladie \u00e0 compter du 1er mars p\u00e9nalise et stigmatise une fois encore les agent\u00b7es de la Fonction publique. Cette mesure vient s\u2019ajouter \u00e0 la suppression de la GIPA, \u00e0 l\u2019absence de mesures salariales g\u00e9n\u00e9rales en 2024 et au refus d\u2019en pr\u00e9voir pour 2025\u2026<\/p>\n<p>Par leur mobilisation massive, majoritaire dans d\u2019importants secteurs, le 5 d\u00e9cembre dernier, les personnels de la fonction publique ont signifi\u00e9 leur refus de l\u2019ensemble de ces r\u00e9gressions, dans un contexte budg\u00e9taire pr\u00e9voyant la suppression massive de postes et donc une importante d\u00e9gradation des conditions de travail. La gr\u00e8ve a contraint le gouvernement \u00e0 reculer sur les deux jours de carence suppl\u00e9mentaires, et \u00e0 renoncer \u00e0 la suppression de 4000 postes dans l\u2019Education nationale et de 500 \u00e9quivalents temps plein \u00e0 France Travail, mais les autres mesures demeurent.<\/p>\n<p>C\u2019est donc une nouvelle attaque directe contre des agent\u00b7es qui, chaque jour, assurent des missions essentielles pour le lien social et\u00a0 la lutte contre les in\u00e9galit\u00e9s sociales et territoriales.<\/p>\n<p>Les m\u00e9tiers de la Fonction publique connaissent une redoutable crise d\u2019attractivit\u00e9, cons\u00e9quence du refus de revaloriser les r\u00e9mun\u00e9rations \u00e0 la hauteur de l\u2019engagement des personnels, de la d\u00e9naturation des missions et des conditions de travail d\u00e9grad\u00e9es que g\u00e9n\u00e8rent les politiques d\u2019aust\u00e9rit\u00e9. Le gouvernement choisit de l\u2019aggraver. S\u2019en prendre aux\u00a0 agent\u00b7es de la Fonction publique, c\u2019est affaiblir les services publics d\u00e9j\u00e0 fragilis\u00e9s par l\u2019aust\u00e9rit\u00e9 budg\u00e9taire. Les services publics et la Fonction publique parce qu\u2019ils servent l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral, doivent b\u00e9n\u00e9ficier d\u2019un budget largement plus important et cesser d\u2019\u00eatre la variable d\u2019ajustement budg\u00e9taire.<\/p>\n<p>Cette mesure est aussi une attaque frontale contre un principe fondamental de la S\u00e9curit\u00e9 sociale : prot\u00e9ger celles et ceux qui vivent de leur travail contre les pertes de revenus d\u00e9coulant d\u2019une incapacit\u00e9 \u00e0 travailler en raison de leur sant\u00e9.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>La FSU demande la suppression de cette mesure inique ainsi que du jour de carence.
